INFORMED CONSENT FOR TELEHEALTH

The user of the website, www.doctorescobar.com, identified with ID registered in the application form for online consultation, hereby acknowledges that Telehealth is the set of activities related to health care, services and methods, which are carried out remotely with the help of IT and telecommunications. This includes, among others, Telemedicine, online support, and Tele guidance in health care, which are regulated by the Law 1419, of 2010 and Resolutions 2694 and 3100 of 2020, issued by the Ministry of Health. Similarly, the user recognizes that telemedicine is the remote provision of healthcare services on behalf of healthcare professionals facilitating the access and the opportunity of healthcare services for people who have offer and/or access limitations of these services in their location. Likewise, Tele guidance in health care is the set of actions developed to supply information, give advisory, and counselling to the user in the different components of health care. The reach of the guidance, which I hereby accept, will be informed in the appointment by the health care professional. Finally, tele support is the collaboration required from one health care professional to another one through information technologies in the framework of the relationship of these professionals.
The user acknowledges doctor Julio César Escobar, Medical Doctor specialist in Plastic, Aesthetic and Reconstructive Surgery, with cédula de ciudadanía (Colombian ID) number 16.713.162 from Cali, as the user’s treating doctor and authorizes him to use Telehealth for the user’s medical attention and hereby authorize that the information generated by any of these means be used in any of the phases of healthcare attention: promotion, prevention diagnose, treatment, rehabilitation or alleviation.
The user acknowledges that in the progress of attention, the following documents may be generated:
-clinical record – diagnostic imagery – audio and video recordings – input and output of data from medical devices and sound archives
These have legal reserve and must be stored and kept by the health care service provider, in agreement with the current norm, in particular, the Resolution 1995 of 1998.

The user accepts having been informed that the electronic systems used include security and software protocols, in turn, they have the necessary means to protect and guarantee the authenticity, integrity, accessibility and reliability of all clinical records and the attention in this mode.
The user acknowledges that the use of Telehealth is to provide a better access to medical attention by specialists in situations where face-to-face attention is not possible, giving continuity to the health care attention and obtaining the decision of medical conducts in a more efficient way.
The user accepts that the service through Telehealth is subject to the common system of heath care obligations, generating obligations of means for the professional based on the professional autonomy of the specialist. Therefore, the effective degree of improvement cannot be provided or guaranteed by the professional.
The user accepts the possibility of risks during the healthcare attention through Telehealth in addition to the normal ones known during face-to-face medical attention. These risks include but are not limited to: A: In certain cases, the specialist can consider the information provided is not sufficient and require having a face-to-face medical appointment; B: Delays and even termination of the attention may occur without defining a medical conduct, this is due to failures or deficiencies in the equipment or programs; C: Even though the user has been informed of the monitoring of the security protocol by the specialist, eventually, and with a low frequency these could fail causing the violation of the user’s medical information privacy. Under oath, the user accepts that the information he or she has given to the specialist and the one to be given in the future is true and any anomaly that arises due to the incorrect or inadequate supply of information by the user, does not compromise the specialist’s responsibility.
The user accepts and understands the terms of the present document and recognizes that in any moment the user can revoke the consent in using the modes of Telehealth, which will not affect the user’s attention or treatment in the future.
Attention through Telehealth may imply the need to carry out tests or diagnostic aids in the user’s residence or eventually to attend an IPS to do these, committing the user to get the tests done or to go to the places indicated for these by the specialist.

The user accepts that the informed consent is a medical act which begins with the interaction of the specialist and is formalized with the acknowledgement, acceptance and/or signing of the consent form.
Once everything regarding the attention is explained and doubts are clarified, The user accepts and consents for the consultation to be carried out through the modes of Telehealth by doctor Julio César Escobar, Medical Doctor specialist in Plastic, Aesthetic and Reconstructive Surgery.
I (the user), as Legal representative of the minor _____________________________________, identified with the ID number _____________________________, hereby authorize the healthcare attention through the modes of Telehealth to be carried out by doctor Julio César Escobar. The user accepts this on the date in which the online appointment request is electronically generated.
